Cocaine, Heroin, and Marijuana: Understanding the Legal Differences in Drug Charges

On Behalf of Law Office of William G. Causey Jr. | Sep 26, 2025 | Drug charges

As a board-certified defense attorney in Greensboro, I often see clients who are confused about North Carolina’s drug laws. Not all controlled substances are treated equally under the law, and the distinctions can have a massive impact on your future. Understanding the differences between charges related to substances like cocaine, heroin, and marijuana is the first step in building a strong defense.

Understanding Drug Schedules in North Carolina

In North Carolina, drugs are classified into “schedules” based on their potential for abuse and accepted medical use. The schedule of a drug determines how it is treated by the legal system.

Heroin: Schedule I Drug

Heroin is a Schedule I drug, meaning it has a high potential for abuse and no accepted medical use. As a result, possession of even a small amount of heroin is a felony. The penalties are severe and can significantly impact your life.

Cocaine: Schedule II Drug

Cocaine is classified as a Schedule II drug. While it also has a high potential for abuse, it is recognized for limited medical applications. In North Carolina, possession of cocaine is always a felony, regardless of the amount. If you are charged with trafficking cocaine, which starts at 28 grams, you face mandatory minimum prison sentences that increase as the amount goes up.

Marijuana: Schedule VI Drug

Marijuana is treated differently from heroin and cocaine. It is a Schedule VI substance. If you’re caught with a half-ounce or less, it’s a Class 3 misdemeanor. Possession between a half-ounce and 1.5 ounces is a Class 1 misdemeanor. It becomes a felony only if you have more than 1.5 ounces. Even though marijuana laws are changing in some states, it’s still illegal in North Carolina. Any charge should be taken seriously.

Why Legal Representation Matters

The type of substance, the amount you possess, and whether you intended it for personal use or for sale all play a major role in your case. Any drug conviction can have a long-term impact on your employment, housing, and personal freedom.
